This Privacy Policy explains how Alaka AI Solutions Inc. (“Alaka,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with:

   * our website at alaka.ai and related webpages, forms, and communications (the “Site”); and
   * our software and technology services for customer communications and logistics workflows, including artificial-intelligence functionality and integrations with communications platforms and customer-designated business systems (the “Services”).

Alaka AI Solutions Inc. is a Delaware corporation.

1. Our role in processing personal information

Alaka may process personal information in different capacities depending on the circumstances.

   a. Information Alaka controls

Alaka determines how and why it processes information relating to:

- visitors to the Site;
- people who contact us or request a demonstration;
- prospective and current customer representatives;
- users who administer or operate an Alaka account;
- billing, business-development, security, and support activities; and
- authorized representatives who connect a business account, mailbox, communication channel, or other system to Alaka.

For this information, Alaka generally acts as the controller or business responsible for the processing.

   b. Information processed for our customers

Our customers may use the Services to communicate with their own customers, contacts, shippers, consignees, or other recipients and to connect customer-designated business systems.

When Alaka processes personal information contained in those communications or systems, Alaka generally acts as a processor or service provider on behalf of the relevant customer. That customer determines the purposes of the processing and is responsible for providing required notices, establishing an appropriate legal basis, and giving Alaka lawful instructions.

Requests concerning information processed on behalf of a customer may be referred to that customer, as explained below.


2. Personal information we collect

The information we collect depends on how you interact with Alaka and the features and integrations a customer enables.

   a. Information you provide directly

We may collect information that you provide through the Site or Services, such as:

- name;
- business email address;
- telephone number;
- company name and job title;
- account and profile information;
- information included in contact, demonstration, onboarding, or support requests;
- billing and transaction-related information;
- communications with Alaka; and
- other information that you choose to provide.

Please do not submit sensitive or regulated information through a general website contact form unless we specifically request it.

   b. Website, device, and technical information

When you access the Site or Services, our systems and service providers may automatically process limited technical and activity information, such as:

- Internet Protocol address;
- browser type and device information;
- date and time of access;
- pages or features requested;
- referring webpage;
- account, authentication, and session activity;
- security and diagnostic information; and
- activity needed to operate, protect, and troubleshoot the Site or Services.

Our use of cookies and similar technologies is described in our Cookie Policy.

   c. Customer account and business information

When a business explores, purchases, configures, or uses the Services, we may process:

- business and authorized-user contact information;
- account roles and permissions;
- onboarding and configuration information;
- support communications;
- billing and subscription information; and
- audit, security, and service-usage records.

   d. Connected communications and business systems

When an authorized customer representative connects an account, mailbox, communication channel, or business system, Alaka may receive or process information needed to establish, operate, maintain, secure, and troubleshoot that connection.

Depending on the provider and enabled features, this may include:

- provider, business-account, workspace, mailbox, or tenant identifiers;
- connected email addresses, business telephone numbers, sender identifiers, and basic account or business profile information;
- authorization status, OAuth tokens, credentials, permissions, and related connection records;
- sender, template, label, folder, routing, and account configuration information;
- email and message subjects, bodies, headers, metadata, threads, attachments, sender and recipient information, timestamps, and delivery information;
- labels, folders, read status, and other mailbox organization information;
- contact, recipient, consent, suppression, and opt-out information;
- shipment, booking, tracking, document, and delivery information;
- reference numbers, including shipment, booking, airway-bill, bill-of-lading, container, and similar identifiers;
- carrier, route, milestone, and estimated or actual date information;
- information received from customer-designated transportation-management, tracking, or other business systems; and
- actions taken through a connected account, such as retrieving, sending, replying to, labeling, marking, archiving, moving, or otherwise organizing communications.

For Meta or WhatsApp connections, this information may include Meta Business Portfolio identifiers, WhatsApp Business Account identifiers, business phone-number identifiers, business names and profiles, sender or template configuration, and connection or onboarding status.

For Google Workspace, Gmail, Microsoft 365, Outlook, or Exchange connections, this information may include the connected account’s basic profile and mailbox information and the message, attachment, metadata, label, folder, authorization, and action information described above.

The exact information depends on the customer’s configuration, instructions, systems, communications, and enabled features. We do not use a connected account to access information for purposes unrelated to providing or securing the Services.

   e. Information processed on behalf of customers

The Services may also process:

- language, timezone, notification, and communication preferences;
- conversation and support records;
- artificial-intelligence prompts, responses, tool requests, and related operational records; and
- diagnostic information necessary to operate, secure, and troubleshoot customer-requested workflows.

We do not intend for customers or recipients to submit health information, biometric information, financial-account credentials, government identification numbers, or other highly sensitive personal information through ordinary shipment communications.


3. How we use personal information

We may use personal information to:

- operate, maintain, secure, support, and improve the Site and Services;
- respond to inquiries, demonstration requests, and support requests;
- establish, administer, authenticate, and protect customer and user accounts;
- process onboarding, billing, and business transactions;
- establish and manage customer-authorized connections and integrations;
- read, route, classify, summarize, draft, generate, send, and organize customer communications as requested or configured by a customer;
- retrieve and use shipment-related context, documents, preferences, and business-system information for customer-support workflows;
- provide artificial-intelligence, integration, tracking, notification, and related functionality requested by customers;
- maintain conversation, support, delivery, preference, and operational records;
- prevent fraud, abuse, and unauthorized access;
- monitor performance, diagnose errors, and maintain service reliability;
- communicate about the Services, including operational notices and relevant business communications;
- comply with legal obligations and enforce our agreements;
- protect the rights, safety, and security of Alaka, our customers, recipients, and others; and
- create and use aggregated or de-identified information as described below.

When Alaka processes recipient, communication, mailbox, or customer-system information on behalf of a customer, we use that information to provide the Services in accordance with the customer’s instructions and our agreement with that customer.


4. Google, Microsoft, Meta, and other provider data

   a. Google and Microsoft account data

If you choose to connect a Google Workspace, Gmail, Microsoft 365, Outlook, or Exchange account to Alaka, we access that account only after you or your organization explicitly authorize access through the applicable provider’s consent flow.

Depending on the features enabled, Alaka may use authorized access to read and retrieve messages and attachments, obtain message and account metadata, send authorized communications, and label, mark, archive, move, or otherwise organize messages. We use this access only to provide, secure, support, or improve the customer-facing features that you or your organization request.

We do not sell Google or Microsoft user data. We do not use it for advertising, cross-context behavioral advertising, creditworthiness, or lending purposes. We do not use Google Workspace, Gmail, Microsoft 365, Outlook, or Exchange data to train general-purpose or cross-customer artificial-intelligence models.

We disclose Google or Microsoft user data only as described in this Privacy Policy, including to service providers that help us provide requested user-facing functionality, maintain security, comply with law, or complete a business transaction where permitted and subject to any notice or consent required by the applicable provider’s rules.

Authorized Alaka personnel may access message content only after receiving appropriate authorization to review the relevant content for support, where reasonably necessary to investigate or address security, fraud, abuse, or technical problems, where required by law, or when working with aggregated or de-identified information. Any such access is subject to appropriate access controls and confidentiality obligations.

Alaka’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

   b. Meta and WhatsApp account data

If an authorized customer representative connects a Meta business account or WhatsApp Business Account, Alaka uses the resulting account, business, sender, template, telephone-number, authorization, and technical information to establish and maintain the requested connection, register and manage authorized senders, provide support, maintain security, and disconnect or delete the integration when appropriate.

We do not sell Meta or WhatsApp account information or use it for behavioral advertising or unrelated profiling.

WhatsApp communications are delivered through Meta’s WhatsApp Business Platform, either directly or through an authorized communications provider. Meta, WhatsApp, and applicable communications providers may independently process information under their own terms and privacy policies.

   c. Customer-designated providers

When a customer enables another integration, we may exchange information with the systems or providers selected or authorized by that customer, such as transportation-management systems, tracking services, communications platforms, or document services. Those providers may process information independently under their own terms and policies.


5. Artificial-intelligence processing

The Services may process communication content, attachments, shipment information, customer-system context, preferences, and related instructions through artificial-intelligence and language-model infrastructure to provide customer-requested features such as classification, routing, translation, summaries, information retrieval, and generated or drafted responses.

We may disclose this information to contracted artificial-intelligence infrastructure providers only as reasonably necessary to provide and secure those features and subject to applicable confidentiality, security, and data-protection obligations.

We do not use identifiable recipient message content, connected-mailbox information, or shipment information to train a general-purpose or cross-customer generative artificial-intelligence model unless the relevant customer has expressly authorized that use in writing.


6. Legal bases for processing

Where the European Economic Area, United Kingdom, or similar laws apply, Alaka may rely on one or more of the following legal bases when acting as a controller:

- performance of a contract or pre-contractual steps;
- legitimate interests, such as operating and securing our business, responding to business inquiries, preventing fraud, improving reliability, and conducting appropriate business-to-business marketing;
- consent, where required and obtained;
- compliance with legal obligations; and
- protection of vital interests or establishment, exercise, or defense of legal claims.

Where Alaka acts as a processor, the relevant customer is responsible for determining the legal basis for the processing.


7. How we disclose personal information

We may disclose personal information as described below.

   a. Service providers

We use service providers that support functions such as:

- website hosting and infrastructure;
- cloud storage and computing;
- artificial-intelligence and language-model inference;
- communications, messaging, and email delivery or processing;
- shipment tracking and business-system integrations;
- product monitoring, error detection, and security;
- billing, accounting, and professional services; and
- customer support.

These providers may process personal information only as reasonably necessary to provide their services to Alaka and subject to applicable contractual, confidentiality, security, and legal requirements.

   b. Customers and customer-designated services

We may disclose information to the customer on whose behalf we process it, to that customer’s authorized users, and to systems or providers selected or authorized by that customer.

   Legal, safety, and business disclosures

We may disclose information:

- to comply with applicable law, legal process, or lawful governmental requests;
- to investigate fraud, abuse, security incidents, or violations of our agreements;
- to protect the rights, property, or safety of Alaka or others;
- to lawyers, accountants, insurers, auditors, and other professional advisers; or
- in connection with a merger, financing, acquisition, restructuring, bankruptcy, or sale of all or part of our business, subject to applicable confidentiality, provider-policy, notice, consent, and legal requirements.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising.


8. International data transfers

Alaka is based in the United States, and personal information may be processed in the United States and other countries where Alaka or its service providers operate. These countries may have privacy laws that differ from those in your location.

Where required by applicable law, we use appropriate safeguards for international transfers, which may include contractual protections such as the European Commission’s Standard Contractual Clauses or other legally recognized mechanisms.


9. Retention, disconnection, and deletion

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

- provide, support, and secure the Site and Services;
- fulfill customer instructions and maintain customer accounts and business records;
- maintain conversation and operational records requested by customers;
- resolve disputes and enforce agreements;
- comply with legal, tax, accounting, contractual, or regulatory requirements; and
- maintain limited suppression records needed to honor communication opt-outs.

Retention periods vary depending on the type of information, the customer’s instructions, contractual requirements, legal obligations, security needs, and whether the information is contained in backups, logs, or audit records.

Disconnecting a connected account stops Alaka’s future authorized access after the disconnection is completed. We delete or disable stored authorization credentials associated with the disconnected account, subject to reasonable technical completion and limited security or legal requirements.

Previously stored communications, customer records, or other connected-account data are deleted or de-identified when no longer reasonably needed for the Services, when required by the applicable Customer Agreement or customer instructions, or following an applicable verified deletion, account-closure, or service-termination request, subject to limited legal, security, fraud-prevention, dispute-resolution, suppression-record, and backup exceptions.

Information may remain temporarily in backups until those backups are overwritten or expire under normal retention practices. Information retained for an exception is limited to what is reasonably necessary for the applicable purpose.

When information is no longer required, we delete it or de-identify it in accordance with applicable procedures and agreements. Where Alaka processes information on behalf of a customer, retention and deletion may be controlled by that customer’s instructions and agreement with Alaka.

10. De-identified and aggregated information

We may create aggregated statistics or de-identified information that cannot reasonably be used to identify an individual, recipient, communication, shipment, or customer.

We may use this information to operate, secure, analyze, and improve the Services. We maintain de-identified information in de-identified form and do not attempt to re-identify it except where permitted by applicable law for purposes such as testing de-identification controls.


11. Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, loss, or disclosure.

These safeguards may include:

- encryption in transit;
- appropriate encryption or protection of stored credentials and secrets;
- access controls and tenant separation;
- logging and monitoring;
- vendor review; and
- incident-response procedures.

No method of transmission, processing, or storage is completely secure, and we cannot guarantee absolute security.

Please contact us promptly if you believe information associated with Alaka has been accessed or used without authorization.


12. Your privacy rights

Depending on where you live and the circumstances, you may have rights to:

- request access to personal information;
- request correction of inaccurate personal information;
- request deletion of personal information;
- request restriction of processing;
- object to certain processing;
- request data portability;
- withdraw consent where processing is based on consent;
- opt out of certain sales, sharing, or targeted advertising; and
- appeal a decision concerning a privacy request.

We do not discriminate against people for exercising applicable privacy rights.

  a. How to submit a request

You may submit a privacy request by:

- emailing contact@alaka.ai; or
- following the instructions at alaka.ai/data-deletion.

Please describe your request and provide enough information for us to identify the relevant records. We may ask you to verify your identity or authority before completing a request. We will respond within the period required by applicable law.


  b. Information processed on behalf of a customer

If your request concerns communications, shipment information, or other information that Alaka processes on behalf of a freight forwarder or other customer, that customer is generally responsible for responding to the request.

We may forward your request to the relevant customer and assist that customer in responding. Alaka will act on processor-side information in accordance with the customer’s instructions and applicable law. You may contact Alaka even if you do not know which customer controls the relevant information.

   c. California and other U.S. State Rights

Residents of California and certain other U.S. states may have rights to know, access, correct, or delete personal information and to opt out of certain sales, sharing, or targeted advertising.

Alaka does not sell personal information or share it for cross-context behavioral advertising. Therefore, we do not currently provide a “Do Not Sell or Share My Personal Information” mechanism. If our practices change, we will update this policy and provide any legally required opt-out mechanism.

   d. EEA and UK complaints

Individuals in the European Economic Area or United Kingdom may also have the right to lodge a complaint with the data-protection authority in their country or region.


13. Communication choices and opt-outs

Alaka may send business communications to prospective and current customer representatives. You may opt out of promotional email by using any unsubscribe link provided or by contacting us.

Customers may use Alaka to send operational or business communications to recipients. Those customers are responsible for complying with applicable consent, notice, and communications requirements.

Recipients may communicate an opt-out by replying through a supported messaging channel, using an available unsubscribe method, contacting the relevant business, or contacting Alaka at contact@alaka.ai.

Where Alaka processes an opt-out on behalf of a customer, we apply it according to the customer’s configuration, instructions, applicable provider requirements, and law. We may retain a limited suppression record after an opt-out to prevent unwanted future communications.


14. Cookies and similar technologies

The Site uses only cookies or similar technologies that are strictly necessary to operate, protect, or provide requested Site functionality.

We do not currently use cookies or similar technologies for advertising, behavioral tracking, audience profiling, website analytics, personalization, or social-media tracking. Additional information is available in our Cookie Policy at alaka.ai/cookie-policy.


15. Children’s privacy

The Site and Services are designed for business and professional use and are not directed to children.

We do not knowingly collect personal information directly from children under 13 through the Site. If we learn that we collected personal information directly from a child in circumstances requiring parental authorization, we will take appropriate steps to delete or otherwise address the information.

Customers are responsible for ensuring that the information and recipient lists they provide to Alaka may lawfully be processed through the Services.


16. Third-party websites and services

The Site or Services may link to or interoperate with websites or services operated by third parties. We do not control those third parties or their independent privacy practices. We encourage you to review the notices and settings provided by each third party you use.


17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, practices, third-party requirements, legal obligations, or technology.

When we update the policy, we will revise the “Last updated” date above. If changes are material, we may provide additional notice or obtain consent where appropriate or required by applicable law or provider policy.
